James Fortune’s Charges Become Clear as His Wife Now Being Named as VictimJames Fortune (pictured left with wife) was arrested Friday, October 24th for aggravated assault of a family member. In the initial comments by staffers at the Fort Bend County Sheriff’s office, the name of the victim was withheld. Now Fox 26 Houston (who broke the story) has come up with more details surrounding the unfortunate incident.

Attorney Toni Jones who represents the stepfather of Fortune’s 17 year old stepchild in a civil case against the singer, says Fortune is being accused of throwing a barstool at his wife Cheryl so hard she may require serious medical attention.

“He’s been charged with aggravated assault of a family member with a deadly weapon. And I believe that weapon is being alleged as a bar stool,” Jones said.

Jones represents Roderick Davenport, the biological father of Fortune’s stepson. This past weekend Fortune was arrested in Stafford and charged.

“I believe the Stafford PD were concerned at the time of the investigation interviewing her possibly leg or her pelvis may have been fractured or broken,” Jones said.

The gospel singer was sentenced to six years of deferred adjudication for punishing his 4 year old stepson by putting him in scalding hot water.

In addition to stepchildren, Fortune and his wife have 3 children together.

“The most serious thing that could happen and we’ve seen this happen before is Mrs. Fortune or those children could end up dead,” Jones said.

It remains to be seen what is in the official court documents, but this incident gives fuel to a 5 million dollar civil case brought forth by Attorney Toni Jones’ client.

Fortune is out on bond. If convicted, he could be looking at up to 15 years in prison.
